These Terms of Service ("Terms") govern your access to and use of Oov (the "App," "Service"), operated by the individual doing business as Oov ("Oov," "we," "us," or "our"). By creating an account or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

Oov is intended for users who are 17 years of age or older. By creating an account, you represent and warrant that you are at least 17 years old. We do not knowingly permit use of the App by anyone under this age. If we become aware that an account belongs to someone under 17, we may suspend or terminate it.

2. What Oov Is

Oov lets you share your current emotional state — set by positioning a marker on a two-dimensional plane, which maps to a named emotion and colour — with a small circle of mutually confirmed connections ("oovi"). A shared state is visible to your mutual connections for 24 hours, after which it fades; the App shows nothing after that point rather than an error or placeholder. You may also send a lightweight "nudge" to a connection, limited to once per 24 hours per person.

Oov is not a public social network. There are no public profiles, no search-by-name, and no one-way following — a person can only add you if they already have your invite link, QR code, or exact handle, and a connection only becomes mutual once both sides accept.

3. Not a Medical, Mental Health, or Emergency Service

Oov is not a healthcare service, therapy platform, diagnostic tool, or crisis-response service, and it is not monitored for emergencies. Nothing in the App constitutes medical or mental health advice, diagnosis, or treatment. Oov does not review, respond to, or act on the emotional states you or others share.

If you are in crisis or need immediate help, do not rely on Oov. In the United States, contact the 988 Suicide & Crisis Lifeline (call or text 988). Outside the United States, use the international crisis-line resource linked in the App's Settings, or contact your local emergency services. Oov provides these as informational pointers only and is not affiliated with them.

4. Your Account

• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
• Sign-in is via email magic link through Firebase Authentication. You must provide a working email address you control.
• You choose a unique handle (@handle) and display name. You agree not to impersonate another person or entity, or to use a handle you don't have the right to use.
• You must notify us promptly of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the App to harass, threaten, stalk, or abuse another person, including through repeated unwanted nudges or connection requests.
• Attempt to circumvent the mutual-connection model (e.g., to view another user's state without a confirmed mutual connection).
• Reverse-engineer, scrape, or interfere with the App's normal operation or security measures.
• Use the App for any unlawful purpose or in violation of any applicable law.
• Create multiple accounts to evade a connection limit, a block, or a suspension.

We may suspend or terminate accounts that violate this section, at our discretion, with or without notice.

6. Subscriptions and Billing

Oov offers three tiers, which differ only in how many mutual connections you may have:

• Paid tiers are billed monthly, through Apple's App Store, using the payment method on file with your Apple ID. Oov never receives or stores your payment card details — all billing is handled entirely by Apple.
• Subscriptions automatically renew each month unless cancelled at least 24 hours before the end of the current billing period. Manage or cancel your subscription through your Apple ID account settings.
• Refunds are governed by Apple's App Store refund policies, not by Oov directly. We do not process refunds ourselves.
• We may change subscription pricing or tier limits going forward; changes will not apply retroactively to a billing period you've already paid for.

7. Your Content

The emotional-state data, handle, and display name you provide are yours. By using the App, you grant us a limited licence to store, process, and display that information solely as necessary to operate the features described in these Terms (e.g., showing your current state to your mutual connections). We do not sell your content or use it for advertising.

8. Termination and Account Deletion

You may request deletion of your account at any time. See our Privacy Policy for details on what deletion currently does and does not remove, and expected timelines. We may also suspend or terminate your account for violating these Terms.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OOV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $20.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold Oov harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will make reasonable efforts to notify you in-app or via email before they take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Dehradun, Uttarakhand, India.

14. Miscellaneous

• If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• These Terms, together with the Privacy Policy, constitute the entire agreement between you and Oov regarding the App.
• You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
